By purchasing artwork from me, you are automatically agreeing to the following terms. These terms are subject to change at any time.

Please read thoroughly and contact me before requesting a commission if you have any questions or at [email protected]

I have the right to decline or cancel and refund a commission for any reason, especially if the request does not adhere to the Terms of Service.

All Products I will send to you are digital files and nothing will be sent physically to you

By ordering, You the client are assuring that you are 18 years old or older. I will do background checks on people who commission me for my own safety. If this is found not to be true, you will be blacklisted and reported.

NO NFT's. I don't take cryptocurrency, I DO NOT support NFT's. DO NOT BOTHER ASKING!

Under any circumstances my art is to NOT BE USED FOR A.I. image training

Commission queue is public information that can be found on Trello.

The relationship between myself and you the client is to be kept professional and respectful. Roleplay, inappropriate links, or text will be ignored. Continued inappropriate behavior will result in a commission cancelation and ban.

To be notified of commission openings, ask to be added to the ping list.

Request a commission via the appropriate google form, email, or contact link.

Commissions will be publicly organized into categories on my Trello list once their commission has been accepted.

If your commission request is accepted, I will contact the client to confirm acceptance and will provide a quote, along with any additional necessary questions.

When I send you the finished file, Please be sure to download it as soon as you can. I normally do an annual 'clean-out of my folders and delete old files that I haven't touched in years. If you ask me for the full-size file of a commission 2 years after it was sent to you, there's a chance that I may not have it anymore.

Once payment has been made, the commission will be labeled appropriately on my Trello list.

Work in progress (WIP) will be provided to the client in multiple stages including sketch, line + flat color, shading, and background. The WIP varies between commission types. The client must give a clear confirmation to me after each WIP is given

Major changes can only be made during the sketch stage, such as posing and expressions.

When the commission is finalized, you the client will receive the full-resolution image files. Depending on the commission type you could also receive more file types

I don't post commissions publicly until I receive final approval for the commission. Once final approval is reached I will then post a lower-resolution version of the commission online.

The client may post the commission before the artist, with credit provided. If you wish for your commission to not be public you must state so in your commission form. Know there is a 20% fee for this request.

You may ask me for WIPs and the status of your commission anytime! However, please allow a reasonable amount of time between asking for updates.

I highly encourage redlining during WIP stages, please by all means show me what needs changing.

Prices are listed in USD.

PayPal invoices, Kofi, Venmo, or CashApp, are the preferred payment methods.

Except for Kofi, there will be a 4% tax on your commissions total to make up for the fees taken by Paypal or the other apps. This keeps my prices from having to raise to high

Do not send money to me without my consent. This includes sending money to my Paypal email directly before I have agreed to you doing so.

Tips are always enabled on invoices and are encouraged. If you prefer to tip after commission completion, Kofi is an option for doing so.

I give all clients up to 72 hours to make their initial payment. If payment is not received I will move on to the next person in consideration/waitlisted.

The commission will be started as soon as payment is confirmed. I the artist guarantee a fluent working process and keep the client up to date about the current process of the commission.

You must clarify on your commission form if you wish your commission to be completely private. Understand there will be a 20% fee.

100% refund when canceled before sketch.

50% refund when canceled before linework.

20% refund when canceled before color. and ect.

I humbly ask that I am to be credited when it comes to reuploading to other social media. Please credit me using @PhiaHart

Filing a false chargeback is detrimental to online artists and will not be tolerated. If you do this, I will revoke all of your rights to the image you commissioned, report you and you will be blacklisted from commissioning me ever again.

I reserve the © Copyright for the final product and the right to use it for personal portfolios, presentations, and inspirations. The original high-resolution file will be kept private between me and the client, while only resized or cropped files will be officially published.

I have the right to display commissions on my galleries, portfolio, commission examples, or elsewhere to represent my work. This includes job-related opportunities should I ever need them.

I may choose not to post your commission on certain sites for various reasons or not at all.

I do not have the right to display commissions if private commission fees are requested and paid for by the client. I will adhere to any agreements made at the time of purchase.

I have the right to refuse my service if you the client break the professional boundaries with rude or inappropriate behavior. I will immediately refund your invoice in full, and depending on the severity of the situation, you may be blacklisted from commissioning me again.

Repost and publish their commission where they would like, with credit given.

When crediting, please use "art by PhiaHart"

(Optional) provide a link to my website or relevant social media profile

Use their commission as a banner, profile picture, twitch display, emojis, or other non-commercial use.

Print commissioned work as posters, charms, stickers, shirts, or other merchandise for personal use.

Profit financially from my artwork without permission or credit

Claim the commissioned work as their own. They may claim the idea, character, concept, and overall theme as theirs. The artwork is credited to me as the artist.

Remove my signature or alter my artwork without my consent.

Exceptions may be allowed in the use of icons, emotes, or transparent files.

If you are not the commissioner and want to use a commissioned work for something, you must ask both me and the person who bought the commission.

Sell or use my artwork for NFT or AI purposes or use.

If you are found turning your commission into an NFT or use for AI will result in you being blacklisted.
